Copyright & Intellectual Property Policy

Welcome to Central Bar Association, Lucknow, an eBar Management solution engineered and powered by Develop India Online (DIO). This Copyright Policy outlines the protections, ownership rights, and restrictions concerning all digital assets, code, databases, and content published on this platform.


1. Ownership of Intellectual Property (IP)

All content and materials available on this portal—including but not limited to software code, application architecture, UI/UX design, database structures, text, graphics, bar logos, icons, images, and audio/video clips—are the exclusive property of Central Bar Association, Lucknow and its technology provider, Develop India Online (DIO). All such assets are protected under the Indian Copyright Act, 1957, The Trademarks Act, 1999, and international intellectual property treaties.


2. Limited & Permissible License to Users

Registered advocates, bar members, and public users are granted a limited, non-exclusive, non-transferable, and revocable license to access, view, download, or print factual directory information, notifications, resolutions, and bar records strictly for personal, educational, or non-commercial professional use. This license is subject to the following conditions:

  • You must not remove, alter, or obscure any copyright, trademark, or proprietary notices from any downloaded documents.
  • The materials must not be modified, distorted, or used in a manner that misrepresents the Bar Association or its members.
  • Strict Prohibition on Automated Extraction: Systematic harvesting, scraping, or mining of member data, enrollment numbers, or contact lists using automated tools (such as bots, spiders, or scrapers) is strictly prohibited and constitutes a criminal offense under Section 43 and 66 of the IT Act, 2000.
  • AI Training Restriction: No content or data from this platform may be used to train, fine-tune, or feed Large Language Models (LLMs) or artificial intelligence systems without explicit written consent from DIO.

3. BCI Advocate Policy & Professional Data Protection

In accordance with Rule 36 of the Bar Council of India Rules, advocate data listed on this portal is strictly for informational and regulatory compliance purposes. This directory cannot be copied or repackaged by third parties for commercial legal listing, lead generation, or unauthorized lawyer ranking services. Legal articles or opinions published by members remain the academic property of the respective author, but the platform retains a perpetual license to host and display such content.


4. Digital Personal Data Protection (DPDP) Alignment

As per the DPDP Act, 2023, the compilation of bar members' personal data is protected against unauthorized duplication. Any entity found creating copycat databases, mirror websites, or offline directories using the information harvested from this eBar platform will face immediate legal prosecution for data breach and copyright infringement.


5. Infringement Claims & Takedown Notice (Indian Copyright Act, Sec 51)

If you believe that any material hosted on this website infringes upon your copyright, you may submit a formal Takedown Notice to our designated Grievance Officer in compliance with Section 51 of the Indian Copyright Act, 1957. The notice must contain:

  • Electronic or physical signature of the authorized copyright owner.
  • Clear identification of the copyrighted work claimed to have been infringed.
  • The exact URL link and description of where the infringing material is located on our portal.
  • Your contact details, including full name, address, telephone number, and email.

6. Legal Penalties and Remedies

Unauthorized use, reproduction, or distribution of this platform’s proprietary material will result in strict civil and criminal liabilities. Develop India Online (DIO) and the Bar Association reserve the right to initiate legal proceedings seeking statutory damages, permanent injunctions, and criminal prosecution under Sections 63 and 64 of the Copyright Act, 1957.
