Content Policy

Welcome to Central Bar Association, Lucknow, an eBar Management platform powered by Develop India Online (DIO). This Content Policy governs the access, publication, submission, and management of all text, graphics, data, and digital materials on this platform. By using this portal, you agree to strictly adhere to these terms.

1. Legal Compliance & Statutory Framework

All users, including advocates, bar members, and administrators, must ensure that any content uploaded or shared complies with the applicable laws of India. Content must strictly adhere to:

  • The Information Technology Act, 2000 and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
  • The Digital Personal Data Protection (DPDP) Act, 2023 regarding the handling of personal and sensitive professional data.
  • The Indian Penal Code, 1860 (and/or Bharatiya Nyaya Sanhita, 2023 as applicable) regarding defamation, public order, and hate speech.
  • The Copyright Act, 1957 and The Trademarks Act, 1999.

2. Bar Council of India (BCI) & Advocate Policy Compliance

As an eBar Management platform catering to legal professionals, content publication is strictly bound by the Bar Council of India Rules (specifically Rule 36 of Section IV), which restricts commercial advertising and solicitation by advocates.

  • No Solicitation or Advertising: Advocates and Bar Associations utilizing this platform cannot publish content designed to solicit briefs, advertise legal services, or showcase inflated success rates/claims.
  • Permissible Directory Information: In accordance with the BCI amendment, advocates may only display approved, factual information on their directory profiles (e.g., Name, Bar Council Enrollment Number, Contact Details, Qualifications, and Areas of Practice).
  • Professional Dignity: Any content, legal articles, opinions, or case discussions published on the platform must maintain the highest standards of professional ethics, court decorum, and judicial respect. Contempt of court or disparaging remarks against the judiciary is strictly prohibited.

3. Data Policy & User Privacy

Powering this platform, Develop India Online (DIO) ensures that data governance aligns with the DPDP Act, 2023:

  • Data Accuracy & Integrity: Members must provide true, accurate, and updated information regarding their Bar enrollment status, identity, and contact information.
  • Protection of Privileged Data: Users must not upload confidential client information, privileged communications, or sealed court documents.
  • Unauthorized Harvesting: Scrambling, scraping, or using automated tools to extract member data, email addresses, or phone numbers from this portal for marketing, spamming, or unauthorized databases is a punishable legal offense.

4. Prohibited Content

You are strictly prohibited from hosting, displaying, uploading, modifying, publishing, transmitting, storing, updating, or sharing any information that:

  • Belongs to another person and to which the user does not have any right.
  • Is defamatory, obscene, pornographic, pedophilic, invasive of another’s privacy, insulting or harassing on the basis of gender, libelous, racially or ethnically objectionable.
  • Infringes any patent, trademark, copyright, or other proprietary rights.
  • Violates any law for the time being in force or deceives/misleads the addressee about the origin of the message.
  • Contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of the platform.
  • Threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign states, or public order.

5. Content Moderation & Takedown Policy

Central Bar Association, Lucknow and Develop India Online (DIO) act as intermediaries under Section 79 of the IT Act, 2000. We reserve the right, at our sole discretion, to screen, moderate, modify, disable, or remove any content or member profile without prior notice if it is found violating this policy, BCI rules, or a government/judicial order.
